Amazon’s promotion that allows customers to tip their delivery drivers $5 has reached its maximum value in less than 48 hours, thanks to a large number of participants.

But not everyone is enthusiastic about the initiative, which launched the same day Amazon was sued for allegedly stealing tips from its drivers in previous years.

In a Dec. 7 statement announcing the expansion, the e-commerce giant said users can direct their Alexa-enabled devices to “thank my driver,” and the company will deliver a thank-you note.

The top five drivers with the most certificates will earn $10,000 to keep and $10,000 to give to charity.

“And, in celebration of this new feature, with every thank you received from a customer, drivers will also receive an additional $5, at no cost to the customer,” Amazon said. “We will do this for a million thanks to the first note received.”

Just a day later, Amazon updated its FAQ about the promotion to say that the top section had been completed thanks to an “enthusiastic response” that met the 1 million driver limit.

Customers can still tell Alexa to thank their drivers, and Amazon says it will share feedback, but drivers won’t see financial incentives.

Skeptical social media users quickly noticed that the promotion launched on the same day Washington, D.C., filed a lawsuit against the e-commerce giant, accusing Amazon of stealing tips from its drivers and defrauding customers along the way.

The lawsuit revolves around the launch of Amazon Flex in 2015, which allowed independent contractors to deliver Amazon packages in their own vehicles for $18 to $25 an hour.

The lawsuit alleges that initially Amazon Flex drivers received tips, which they added to customers as default tips. But in 2016, the company quietly changed its rules to show tips to paying drivers. In promotional materials, Amazon continues to assure customers and drivers that “100% of the tip” will go to the driver, even though, technically, the money subsidizes the company’s operating costs.

The Federal Trade Commission filed similar charges against Amazon, and in a 2021 settlement, the company agreed to reimburse drivers nearly $62 million. Amazon also agreed to stick with its original payment model — allowing drivers to keep 100% of the tips they give — unless management gets drivers’ express permission to change the formula.

In filing the suit, DC Attorney General Carl Racine alleged the company violated the district’s consumer protection laws. Although Amazon has settled with the FTC, it says the company has “avoided appropriate liability, including civil penalties, for harm to consumers.”

“Nothing is more important to us than the trust of our customers,” he said. “This lawsuit involves a practice we changed three years ago […]. All of the tips in question were paid to drivers as part of last year’s settlement with the FTC.”

For millions of customers, the company’s annual subscription service, Prime, paved the way for strong online shopping habits. For the current price of $139 per year, US it. Customers can get free two-day, sometimes two-hour shipping.

But maintaining Amazon’s delivery speed (and customers’ expectations of convenience) involves a highly automated work model that, some workers say, is also dehumanizing.

The company’s last-mile delivery drivers are paid an average of $44,000 a year to deliver about 200 or more packages per day.

They say they sometimes urinate in empty water bottles to meet their daily quota. They work regularly in extreme weather conditions, even on bad country roads. And they’re suffering physically because of it: more than 110 motor vehicle injury lawsuits have been filed against the company in 2021 alone.

They were greeted by documented anti-union practices. Just a few weeks ago, the firing of an employee who tried to organize prompted a federal judge to issue a cease and desist order against the company.

Amazon did not respond to questions about whether the popularity of the “Thank My Driver” initiative inspired the company to make it easier for customers to tip drivers.

When staff tried to ask Alexa through the Echo speaker for “tips for my driver”, the system replied that “we can’t give them advice right now”. The company allows in-app tipping for its Amazon Fresh grocery delivery service.

Several startups are reportedly exploring ways to build a tipping platform for Amazon drivers, but testing so far has remained hyperlocal.

Another question is whether this application will be widely used. Overall peak numbers appear to have declined in recent months, possibly due to rising inflation or the end of pandemic quarantines.

On the popular Reddit forum r/Amazon/DSPDrivers, drivers regularly post photos of households leaving carts full of packaged snacks, soft drinks and handwritten thank-you notes during the holidays.

“I like people who care!” One person wrote in the comments a special festive stroller. “It makes my blister on my blister feel better.” The new education program funds participating delivery service partners up to $5,250 per eligible driver annually to access more than 1,700 academic programs, and Amazon will contribute an additional $60 million to help DSPs match employee 401(k) contributions.
